SUMMARY:

Under the NCN Community Protection Law, the Peacekeepers Tribunal has been established to carry out the functions of the Peacekeepers Tribunal Law

RESPONSIBILITIES:

  • Providing overall administration and coordination of the delivery of services by the Peacekeepers Tribunal
  • Maintaining data and other statistical records for the services provided by the Peacekeepers Tribunal
  • Establishing and maintaining a registry of evictions and banishments in accordance with the Nisichawayasi Community Protection Law, 2019, c, C-1 and their disposition by the Peacekeepers Tribunal
  • Performing other duties assigned by the portfolio holder, Chief and Council or NCN Laws.
  • Prescribing the oaths of office for members of the Peacekeepers Tribunal.
  • Prescribing the factors the Peacekeepers Tribunal must take into account when deciding if persons banished from N’tuskenan should be allowed to return.
  • Prescribing the factors the Peacekeepers Tribunal must take into account when deciding if persons convicted of murder, manslaughter or sexual assault of any nature should be allowed to run for the position of chief or councillor.
  • Prescribing the factors the Peacekeepers Tribunal must take into account when considering complaints against Peacekeepers.
  • Consider and act on any other matter necessary for the effective and efficient operation of the Peacekeepers Tribunal
  • The Executive director will be responsible for the management of Kehtiyatisuk, a Oskatis, and appointed Citizen/resident on NCN Lands and with knowledge and experience in relation to investigations and/or the application of laws

The Peacekeepers Tribunal, overseen by the Executive director shall have jurisdiction to determine:

  • If a removal of benefits eviction or banishment order should be issued under the Nisichawayasi Community Protection Law
  • Whether an NCN Citizen who was convicted of an indictable offence other than murder, manslaughter or a sexual assault of any nature should be allowed to run for Chief or Council
  • The validity of any complaints made about a Peacekeeper
  • Whether a matter should be referred to a Peacemaker or the Nisichawayasi Wellness Court for disposition
  • Any other matters referred to it in accordance with an NCN Law
  • The Peacekeepers Tribunal shall have the authority to determine any constitutional questions that arise in matters before the Tribunal

Qualifications

  • An understanding of Othasowewin, NCN Laws, N’tuskenan Nehethowewin, and the customary laws of the Nisichawayasi Nehethowuk, particularly the application of Kwayaskonikiwin.
  • Active listening skills and sound judgement including the ability to assess credibility
  • Good oral, written and inter-personal communication skills
  • Applicants must not have any conflicts of interest or a perception of bias

Appointment

Chief and Council shall take diversity and equality into consideration when appointing five persons who meet the qualifications in subsection (4) to the Peacekeepers Tribunal to carry out the functions set out in this law and other NCN Laws. The Peacekeepers Tribunal is a two-year or three-year term.
