Clarification Regarding Banishments and Recent Decisions

The Chief and Council of the Nisichawayasihk Cree Nation (NCN) wish to clarify misinformation circulating in the community and on social media regarding banishments and related legal matters.

First and foremost, all existing banishments have not been rescinded. 

Any decisions to lift a banishment will occur strictly on a case-by-case basis, following a formal review process. Individuals who have been banished must first submit a written request for a hearing to Terry B. Linklater, Director of Justice, in order to have their situation reviewed. Once a request is received, a hearing will be scheduled before the NCN Peacekeepers Tribunal, which will carefully consider all relevant facts, circumstances, and safety concerns before making a determination.

We also wish to correct false information currently being shared.

  1. Mr. Terry Francois did not win any court case in relation to these matters.
  2. No financial settlement of any kind has been paid or awarded to Mr. Francois or to any other party.
  3. The Nation’s decision to reinstate Mr. Francois does not mean that all banishments have been overturned or invalidated.

The decision to lift Mr. Francois’ banishment was made after careful consideration and on compassionate grounds.

The safety, security, and well-being of our community remain our top priorities. NCN continues to uphold its laws and processes in a fair, transparent, and culturally grounded manner, while also respecting principles of due process, accountability, and community healing.
